Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are a binding agreement between you ("You," the "User," or, where you act for an organization, the "Customer" or "Organization") and TrustSensai, LLC, a Delaware limited liability company ("TrustSensai, LLC," "we," "us," or "our"), the operator of the RiskSensai platform (the "Platform"). By accessing or using the Platform and the related digital-trust and audit-readiness software and Advisor marketplace (together, the "Services"), you agree to be bound by these Terms. If you are entering into these Terms on behalf of an Organization, you represent that you are authorized to bind that Organization. If you do not agree to these Terms, do not use the Services. We may modify these Terms from time to time; changes are effective upon posting the updated Terms, and your continued use of the Services constitutes acceptance of the revised Terms.

2. Service Description

RiskSensai is a business-to-business digital-trust and audit-readiness platform. The Services include:

• Digital Trust Assessment: A free, self-attested questionnaire, optionally paired with externally observed checks of your public internet configuration (such as SPF, DMARC, DKIM, and TLS records and public breach-corpus lookups). These checks observe publicly available information only and are not a vulnerability scan, penetration test, or intrusion of your systems.
• Certification-Readiness Workspaces: Tools to prepare for frameworks such as SOC 2 and ISO 27001, including gap analysis, policy generation, evidence collection, and prepared-by-client (PBC) checklists. These workspaces help you get ready for an external audit or certification; they do not perform one.
• Governance and Risk Modules: Tooling for AI governance, privacy operations (such as DSAR handling, RoPA, and DPIA), vendor-risk management, and incident readiness.
• Readiness Modules: Internal-audit, IT-audit, fraud-risk, and enterprise-risk readiness workspaces to help you organize controls, evidence, and documentation.
• Trust Center: A public page you may choose to publish to share your security and compliance posture with customers and prospects.
• Advisor Marketplace: A marketplace that matches Customers with vetted independent Advisors (also referred to as consultants), such as virtual CISOs, privacy professionals, and IT auditors, who can review your materials.

What the Services Are Not: RiskSensai does not issue audit opinions, certifications, attestations of compliance, or assurance of any kind, and TrustSensai, LLC is not a law firm, a certified public accounting (CPA) firm, or an accredited certification body. The Services provide readiness and advisory information to help you prepare for audits, certifications, and related processes conducted by qualified third parties. Nothing in the Services constitutes legal advice, accounting or audit services, or a certification of your organization.

Advisor Reviews. Where an Advisor reviews your materials, the Advisor may attest only that a review was performed. An Advisor review is not an audit opinion, certification, accreditation, or guarantee of compliance or security, and it does not create any such assurance by RiskSensai or TrustSensai, LLC. Advisors are independent professionals as described in Section 7.

Externally Observed Checks. Any externally observed checks reflect publicly available information at the time they are run and may be incomplete or out of date. You are responsible for the accuracy of the self-attested information you provide, and results depend on that information.

3. User Accounts

Account Creation

You must create an account to access certain features. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized account access
• Be responsible for all activities under your account

Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Payment Terms

Fees and Billing

• The Digital Trust Assessment and other features designated as free are available at no charge
• Paid plans are offered on a subscription basis as described on our pricing page
• The optional "Reviewed" Advisor add-on (an independent Advisor review) may be purchased separately as described at the point of sale
• Subscription fees are billed in advance on a recurring basis unless otherwise stated
• All fees are exclusive of taxes, which are your responsibility except where we are required to collect them
• When online checkout is enabled, we intend to use Stripe as our payment processor and will not store full payment-card numbers ourselves
• You authorize us (and our payment processor) to charge your payment method for all fees you incur

Online Checkout Not Yet Enabled. RiskSensai is in a pre-launch phase and online checkout is not currently enabled. Until it is, no charges are processed through the Platform, and any pricing shown is for informational purposes and may change before launch.

Refund Policy

30-day money-back guarantee on paid subscription plans. This policy applies when paid subscriptions become available. If you are not satisfied with a paid plan, you may request a refund of your first subscription payment within 30 days of the date that payment was charged. Approved refunds return the full amount of that first payment to the original payment method. The guarantee applies once per account and covers the first payment only; later renewal payments are not covered by it.

How to request a refund. Use the form on our contact page from the email address on your account within the 30-day window. You do not need to give a reason. Refund requests are reviewed by our support team; submitting a request does not automatically move money. Approved refunds are processed to the original payment method and typically appear within 5 to 10 business days, depending on your bank or card issuer.

What the refund does and does not affect.Requesting a refund cancels the paid plan. Your account reverts to the free tier, and paid-tier features stop being available. Work you completed while subscribed remains yours, and we do not claw back client relationships you took on during the period. Amounts you separately paid to an Advisor, and fees charged by an Advisor to their own clients, are governed by that Advisor's engagement terms rather than this policy. Except as stated in this section or expressly stated at purchase, fees are non-refundable except as required by applicable law.

Price Changes

We reserve the right to modify our fees at any time. We will provide notice of any price changes affecting your active subscription at least thirty (30) days in advance, and changes will take effect on your next billing cycle after the notice period.

5. Intellectual Property

Our Content

The Services, including all software, content, features, functionality, designs, control catalogs, policy templates, logos, and trademarks (excluding your User Content), are owned by TrustSensai, LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, resell, or create derivative works from the Services without our express written permission.

Your License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your Organization's internal business use in accordance with these Terms. Policy and document templates generated for you may be used for your Organization's own compliance purposes.

6. User Content

As between you and TrustSensai, LLC, the Customer retains ownership of the content it submits to the Services, including assessment answers, uploaded evidence, policies, and other materials ("User Content"). By submitting User Content, you grant TrustSensai, LLC a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your User Content solely to provide, maintain, secure, and improve the Services for you, and as otherwise described in our Privacy Policy. Where you engage an Advisor, you authorize us to make the relevant User Content available to that Advisor for the purpose of their review.

You represent and warrant that:

• You own or have the rights to submit all User Content and to grant the license above
• Your User Content does not violate any third-party rights or applicable law
• Your User Content does not contain illegal, harmful, or infringing material
• You are responsible for the accuracy of self-attested information and for maintaining your own backups of critical records

You may terminate your account at any time through your account settings or by contacting us. We may suspend or terminate your account immediately without notice if you violate these Terms or engage in prohibited conduct.

Upon termination:

• Your right to access and use the Service will cease
• We will delete your account data in accordance with our Privacy Policy
• You remain responsible for any fees incurred before termination
• Provisions that by their nature should survive termination will remain in effect

After your account is terminated, we handle your information as described in our Privacy Policy and applicable law. Where you enable automated features or agents, you remain responsible for reviewing their output and configuration.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. The state and federal courts located in Delaware shall have exclusive jurisdiction over any dispute arising from these Terms or the Services, and each party consents to personal jurisdiction and venue in those courts. Either party may bring an individual claim in small claims court where eligible.

Class Action Waiver

To the extent permitted by law, you agree that disputes will be resolved on an individual basis only, and you waive any right to participate in class actions.
